1. Acceptance of Terms

These Terms & Conditions ("Terms", "Agreement") constitute a legally binding agreement between you ("User", "you", or "your") and the developers and operators of Nimda AI ("Company", "we", "us", or "our").

By downloading, installing, registering, accessing, or using the Nimda AI mobile application (Package: com.nimda.nimda_ai) or its official website, you represent and warrant that:

1. You have read, understood, and agree to be bound by these Terms and our Privacy Policy.
2. You are at least 18 years of age (or the legal age of majority in your jurisdiction), or you possess legal parental or guardian consent.
3. You have the legal capacity to enter into this binding Agreement.

IF YOU DO NOT AGREE WITH ANY PART OF THESE TERMS, YOU MUST NOT DOWNLOAD, INSTALL, ACCESS, OR USE NIMDA AI.

2. Strict Veterinary Domain Mandate (Non-Human Health Use Only)

Nimda AI is developed and restricted 100% EXCLUSIVELY to domestic animals, pets, livestock, and wildlife care:

• Prohibited Human Health Inquiries: You must NEVER use this application for human health inquiries, human symptoms, personal illness, human medications, human dosages, or human emergencies.
• Automated Refusal Rule: The AI assistant contains hardcoded clinical safety guardrails that automatically decline and refuse any questions regarding human symptoms, medications, or diseases.
• Zero Human Liability: The Company disclaims any and all liability arising from any user's attempt to apply information from this application to human beings.

3. Scope of Services & Clinical Nature of AI Triage

Nimda AI provides automated tools to assist animal caregivers during triage:

1. Multimodal Symptom Inspection: The app allows users to upload animal wound photos or input text/voice descriptions. Google Gemini Multimodal AI parses the input to verify animal species and highlight visible clinical indicators (e.g., cuts, abrasions, swelling, discharge).
2. Live Spoken Voice Consultation (Dr. Nimda AI): A hands-free conversational interface designed to deliver spoken supportive first-aid advice when your hands are occupied holding an injured animal.
3. Supportive Physical First Aid: Guidance is strictly restricted to safe, non-medicinal, physical stabilization measures (e.g., flushing with clean lukewarm water or sterile 0.9% saline, applying direct pressure with clean gauze, non-restrictive bandaging, and thermal shock prevention).
4. Veterinary Clinic Discovery: A geolocation utility using OpenStreetMap to display registered veterinary practices and hospitals within 10 km.

You acknowledge that AI models, while sophisticated, may occasionally make interpretive errors, fail to detect hidden internal trauma, or mischaracterize symptoms. AI advice must NEVER override the clinical judgment of an in-person licensed veterinarian.

1. Account Creation: To access personalized features, users may register an account using Google Firebase Authentication (Email/Password or Google Sign-In).
2. Credential Security: You are solely responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
3. Accurate Information: You agree to provide accurate, current, and complete information during registration.
4. Unauthorized Access: You agree to notify us immediately at support@nimda-ai.web.app if you suspect any unauthorized access or breach of your account security.

6. User Data, Privacy & Account Deletion Rights

Your privacy is governed by our official Privacy Policy. In strict compliance with Google Play Store Developer Policies:

1. Complete In-App Deletion: You retain the absolute right to permanently delete your account, UID, email, and authentication credentials at any time from within the app by navigating to: Settings & Profile > Account Actions > Delete Account.
2. Public Web Deletion Portal: If you have uninstalled the application or cannot access your device, you may submit an account deletion request through our public portal at: https://nimda.in/account_deletion.html or by emailing support@nimda-ai.web.app from your registered account email.
3. Ephemeral Consultation Data: In-app consultation chat messages and uploaded wound images are processed in volatile device RAM and are NOT stored on remote persistent databases. When you delete your account or end a session, all associated personal records are permanently erased.

7. Location Services & Third-Party Clinic Data

1. Geospatial Discovery: Nimda AI accesses approximate or precise GPS coordinates strictly Just-In-Time to display veterinary clinics within a 10 km radius.
2. Third-Party Mapping: Clinic listings, names, and contact coordinates are sourced from public OpenStreetMap nodes and launched via Google Maps.
3. Independent Verification: We do not own, operate, or endorse any third-party veterinary clinic displayed. We do not guarantee clinic operating hours, emergency capabilities, staff qualifications, or pricing. You are responsible for calling the clinic directly to verify availability before traveling.

8. Permitted Use & Prohibited Conduct

You agree to use Nimda AI solely for lawful, ethical, personal, or educational animal care purposes. You shall NOT:

1. Reverse Engineer: Decompile, reverse assemble, reverse compile, or extract source code, proprietary prompt algorithms, or model weights from the app.
2. Automated Scraping: Use bots, crawlers, scrapers, or automated tools to access, monitor, or extract data from the app or backend endpoints.
3. Service Interference: Disrupt, tamper with, or place an unreasonable load on the servers, Google Gemini API endpoints, or network infrastructure.
4. Harmful Exploitation: Use the application to facilitate animal cruelty, illegal animal fighting, unauthorized wildlife capture, or abusive practices.
5. Misrepresentation: Claim that any AI consultation report generated by Nimda AI constitutes an official, licensed veterinary medical certificate or prescription.

9. Intellectual Property Rights

The Nimda AI application, software code, UI design, visual layouts, clinical prompt architecture, Dr. Nimda persona, graphics, brand logos, and original documentation are the exclusive intellectual property of the Company and are protected by copyright, trademark, and applicable intellectual property laws.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the application on your personal Android device.

10. Disclaimer of Warranties ("As-Is" Basis)

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE NIMDA AI APPLICATION AND ALL SERVICES, AI TRIAGE GUIDANCE, AND CONTENT ARE PROVIDED STRICTLY ON AN "AS-IS" AND "AS-AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS, IMPLIED, OR STATUTORY.

WE SPECIFICALLY DISCLAIM:

1. ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR VETERINARY PURPOSE, TITLE, AND NON-INFRINGEMENT.
2. ANY WARRANTY THAT THE AI TRIAGE RECOMMENDATIONS WILL BE COMPLETELY ACCURATE, EXHAUSTIVE, UNERRING, OR CAPABLE OF SAVING AN ANIMAL'S LIFE IN EVERY CLINICAL SCENARIO.
3. ANY WARRANTY OF UNINTERRUPTED, DELAY-FREE, OR ERROR-FREE SERVICE AVAILABILITY.

ANIMAL HEALTH REPRESENTS A HIGHLY DYNAMIC, UNPREDICTABLE BIOLOGICAL DOMAIN. YOU EXPRESSLY ACKNOWLEDGE THAT YOUR RELIANCE ON AUTOMATED AI TRIAGE IS AT YOUR OWN VOLUNTARY RISK.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW:

IN NO EVENT SHALL THE COMPANY, ITS DEVELOPERS, AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OR INFRASTRUCTURE PARTNERS (INCLUDING GOOGLE LLC) BE LIABLE FOR:

1. ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES WHATSOEVER.
2. ANY LOSS OF ANIMAL LIFE, DETERIORATION OF ANIMAL HEALTH, AGGRAVATION OF INJURY, OR EXTENDED VETERINARY MEDICAL EXPENSES ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE NIMDA AI SERVICE, OR YOUR RELIANCE ON ANY AI-GENERATED TRIAGE GUIDANCE.
3. ANY ACTS, OMISSIONS, DIAGNOSES, OR MEDICAL MALPRACTICE COMMITTED BY ANY THIRD-PARTY VETERINARY CLINIC OR DOCTOR DISCOVERED THROUGH THE APPLICATION.
4. ANY UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR ACCOUNT DATA.

MONETARY CAP: IN ALL CASES, THE TOTAL AGGREGATE LIABILITY OF THE COMPANY FOR ANY AND ALL CLAIMS ARISING OUT OF THESE TERMS OR THE SERVICE SHALL BE STRICTLY LIMITED TO THE AMOUNT PAID BY YOU TO ACCESS THE APPLICATION (WHICH IS ZERO FOR FREE USERS), OR ONE HUNDRED UNITED STATES DOLLARS ($100 USD), WHICHEVER IS LESS.

12. Indemnification

You agree to defend, indemnify, and hold harmless the Company, its contributors, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or legal fees arising out of or relating to:

1. Your violation of these Terms & Conditions.
2. Your misuse of the Nimda AI application or guidance.
3. Your administration of any toxic substances or inappropriate medical treatments to animals.
4. Your violation of any applicable animal welfare laws or regulations.

13. Modifications to Service & Terms

We reserve the right, at our sole discretion, to modify, update, suspend, or discontinue any feature of Nimda AI at any time without prior notice.

We may revise these Terms & Conditions periodically to reflect changes in legal mandates, veterinary safety standards, or Google Play policies. We will notify you of material updates by revising the "Last Updated" date at the top of these Terms and providing prominent notice within the app. Your continued use of the application following the posting of revised Terms constitutes your full acceptance of the changes.

14. Termination

1. By User: You may terminate this Agreement at any time by permanently deleting your account and uninstalling the mobile application.
2. By Company: We reserve the right to suspend or terminate your account and access to the application immediately, without prior notice, if you breach any provision of these Terms or engage in fraudulent or harmful conduct.

15. Governing Law & Jurisdiction

These Terms & Conditions shall be governed by, construed, and enforced in accordance with the laws of the jurisdiction in which the developer resides, without regard to its conflict of law principles. Any legal suit, action, or proceeding arising out of or related to these Terms or the application shall be instituted exclusively in the competent courts of that jurisdiction.

16. Severability & Waiver

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions. No waiver by the Company of any term or condition shall be deemed a further or continuing waiver of such term.
